CONDITIONS
At the Singles Dining Club we work carefully
with our suppliers to provide a setting in which dining and socialising can be
enjoyed without distraction. To achieve this we often make our reservations and
payments with hotels and restaurants many months in advance - confirming our
table bookings and room reservations to avoid overbooking, a situation
sometimes found in hotels and restaurants. As a result we incur charges when
cancelling or reducing numbers. We therefore operate in a structured fashion to
ensure you receive the maximum enjoyment when attending an event. As it is very
difficult to re-sell accommodation / meals / events at short notice we apply
certain conditions to our reservations so do please read our terms and
conditions below.
All arrangements are made between Nicholas
Joyce trading as the Singles Dining Club (hereinafter called the Club) and you,
the member. The Club is a proprietary club the sole manager of which is
Nicholas Joyce. You have no entitlement or any interest in the subscriptions,
membership fees, profits or pre payments for events made to the Club.
What
is included?
Unless otherwise specified, the cost of each
event includes: maps and directions to the event, pre-dinner drinks (either of
your choice or a set aperitif as described in diary notes), introductions to
other members, lunch or dinner as specified, up to half a bottle of good
quality wine, mineral water, coffee and service charges. Tobacco, liqueurs or
other drinks are not included.
Smoking
For your comfort and the comfort of your
fellow members there is a No Smoking policy at the table until after dessert.
How
to book an event
Just look through the diary, choose your
event(s), and call us on 01424 44 55 66 to book a place. We will contact you,
usually on the next working day, to acknowledge receipt of your booking (this
creates a legally binding contract between us and payment becomes due). Then
send us a booking form with payment. If an event
is already fully booked you will be offered a place on the waiting list and we
will contact you if we have a cancellation. To avoid disappointment we do
suggest you book for events as early as possible.
Payments
A contract will exist as soon as we accept
your booking whether verbally or in writing and payment becomes due at that
time. Payment may be made by cash, cheque or postal order. We do not accept
credit cards. Cheques should be made payable to: "Mr N. Joyce" and
sent to our Bexhill office with a booking form as soon as you have made your
telephone booking. The Club is not under any obligation to deliver any tickets,
coupons, vouchers or documents until full payment of the booking has been
received by the Club.
Special
requests
If you have any special requests, you must
ensure they are advised to us at the time of booking and clearly noted on your
booking form. Whilst we will endeavour to pass any such requests to the
supplier(s) concerned, we cannot guarantee that any requests will be met and
failure to do so will not be a breach of contract on our part.
Behaviour
. The Singles Dining Club reserves the right
in its absolute discretion at all times to cancel or terminate event
arrangements. We also reserve the right to be able to ask you to withdraw from
an event if in our reasonable opinion, or in the reasonable opinion of any
other person in authority, you behave in such a way as to cause or be likely to
cause danger, upset or distress to any third party or any damage to property.
In particular any drunken or inappropriate behaviour particularly towards
female members will not be tolerated. In these circumstances, the Club shall
not be liable to cover any expense incurred by you or to make any refund or pay
any compensation. The Club shall in addition be entitled to impose cancellation
fees.
Cancellations
and No-Shows by members
Late cancellations and non-attendance by
members (or guests) at an event can spoil things for other members. Once you
book your place at an event, we will reserve the place and it is your
responsibility to telephone and cancel if you are unable to attend. To avoid
cancellation charges you must telephone the Club on 01424 44 55 66 (or by fax
on 01424 42 42 46) ten days before the event. Should you notify us in writing
the cancellation will only be accepted when we receive the cancellation, not
from the date of postmark. Payments received will not be refunded if you are
forced to cancel within ten days of the event. The Singles Dining Club reserves
the right to treat any booking that has not been paid for in full by ten days
before the event as cancelled by you.
Under these circumstances, you will be
liable for cancellation charges and full costs will be invoiced.
A contract will exist as soon as we accept
your booking whether verbally or in writing and full payment becomes due at
that time. In the case of late bookings a contract will exist between us as
soon as you have received verbal confirmation from us and been advised of times
and directions. Late bookings are defined as all bookings made within 10 days
of the event and must be made by telephone in order to ensure that the place is
available. You will be liable to pay the full costs of this late booking even
if you subsequently change your mind, as we are obliged to cover costs as soon
as the booking is made. If we need to specially request or provide services on
your behalf in order to confirm your booking, you must provide any necessary
payment. You will be liable to pay for these services even if you decide not to
proceed with the booking.
Changes
and cancellation by the club
We start planning events many months in
advance. Occasionally, we have to make changes to and correct errors in the
diary and other details both before and after bookings have been confirmed and
even cancel confirmed bookings. Whilst we always endeavour to avoid changes and
cancellations, we must reserve the right to do so. However most changes are
minor. If we have to make a significant change or cancel, we will tell you as
soon as possible and offer you the choice of accepting any alternative
arrangements made by us (which may require you to pay any price difference or
require us to refund you for the price difference if the alternative event is
cheaper) or cancelling in which case you will receive a full refund of all
monies you have paid to us.
Where we are forced to make a change or
cancel as a result of unusual and unforeseeable circumstances beyond our
control, the consequences of which we could not have avoided, the Singles
Dining Club accepts no liability whatsoever for non-availability of places or
cancellations, other than the return of any payment fee that has been paid.
Liability
In making arrangements on behalf of its
members, the Club contracts with third parties for provision of all the
necessary facilities including the provision of tickets for entry to the
event/occasion. In doing so it is expressly agreed that the Singles Dining Club
acts only as agent of the member and that it accepts no liability of any kind,
howsoever caused, in connection with or arising out of such arrangements. The
contract between the Club and the member will be subject to any terms and
conditions of contracts with third parties. In the event that such facilities
or tickets are not available, for any reason, any liability of the Club will be
limited to the return of all sums paid by the member for such facilities or
tickets. Whilst we endeavour to secure tables or tickets in an acceptable
location at each venue the Singles Dining Club cannot control the location of
seating at any venue and has no liability if any member feels this is
unsatisfactory.
Alterations
or cancellations of arrangements
by third parties
When the arrangements and/or facilities for
any event are changed or cancelled by a third party, the Club will use its best
endeavours to provide a suitable alternative and/or secure a refund for the
member only of monies paid to a third party, but is not obliged and cannot
guarantee to do so
Publicity
The Club may use photographs of members at
events for publicity purposes from time to time. If you object to this you must
make it clear to us at each event that you attend.
Acceptance
of conditions
The making of a booking with us shall be
deemed as acceptance by the member (or guest) of the above terms and
conditions. We do not accept bookings on any other terms.
Continuation
of contract terms
Should any of the terms of our contract be
officially declared void or unenforceable, the remainder of our arrangements
shall remain, where possible, in full force and effect.
Jurisdiction
This agreement is made subject to the
exclusive jurisdiction of the Courts of England & Wales.
